Terms of Service

1. Acceptance of Terms
By accessing or using HydroPrep ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including free, trial, and paid subscribers.
2. Description of Service
HydroPrep provides a cloud-based stormwater drainage analysis tool for civil and hydraulic engineers. The Service includes network modelling, peak flow calculations using the Rational Method, and report generation. Results are provided for design assistance only and must be verified by a licensed professional before use in any regulatory submission.
3. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must provide accurate information and notify us immediately of any unauthorised use.
4. Acceptable Use
You agree not to misuse the Service, including but not limited to: attempting to reverse-engineer the software, scraping data, circumventing subscription limits, or using the Service for unlawful purposes. We reserve the right to suspend or terminate accounts that violate these terms.
5. Intellectual Property
All software, algorithms, designs, and content within the Service are the intellectual property of HydroPrep and its licensors. You retain ownership of data and models you create. By using the Service, you grant HydroPrep a limited licence to store and process your data solely to provide the Service.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. HYDROPREP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALCULATION RESULTS WILL MEET REGULATORY STANDARDS. ALL RESULTS MUST BE INDEPENDENTLY VERIFIED BY A QUALIFIED ENGINEER.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYDROPREP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON CALCULATION RESULTS IN DESIGN OR REGULATORY SUBMISSIONS.
8. Subscription and Billing
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. Free trials automatically convert to a free tier at expiry unless a payment method is added.
9. Termination
Either party may terminate at any time. Upon termination, your right to access the Service ceases. You may export your project data before termination. We may retain anonymised usage data for product improvement.
10. Governing Law
These Terms are governed by the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
11. Changes to Terms
We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
